1. Acceptance of Terms

By accessing or using Agentic ("the Service"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service. We reserve the right to modify these terms at any time.

2. Description of Service

Agentic is an AI-powered business assistant platform that enables businesses to automate customer interactions through AI agents deployed on WhatsApp, Instagram, and other messaging channels. The Service includes conversation management, contact management, analytics, and workflow automation.

3. Account Registration

• You must provide accurate and complete information when creating an account
• You are responsible for maintaining the security of your account credentials
• You must be at least 18 years old to use the Service
• One person or entity may not maintain more than one free account

4. Subscription & Payments

Agentic offers a free plan and paid subscription plans. Paid plans are billed monthly or annually through LemonSqueezy. You may cancel your subscription at any time. Upon cancellation, you will retain access until the end of your current billing period, after which your account will be downgraded to the free plan. Refunds are handled on a case-by-case basis.

5. Acceptable Use

You agree NOT to use the Service to:

• Send spam, unsolicited messages, or bulk communications
• Violate any applicable laws or regulations
• Impersonate another person or entity
• Transmit malware, viruses, or harmful code
• Attempt to gain unauthorized access to other accounts or systems
• Use the AI agent to generate harmful, misleading, or illegal content
• Exceed your plan's usage limits through automated means

6. AI-Generated Content

The AI agent generates responses based on the information you provide and Google's Gemini AI models. You are responsible for reviewing and monitoring the content your AI agent produces. Agentic does not guarantee the accuracy, completeness, or suitability of AI-generated responses.

7. Data Ownership

You retain ownership of all data you provide to the Service, including business information, customer contacts, and conversation history. Agentic does not sell your data to third parties. Upon account deletion, your data will be permanently removed within 30 days.

8. Limitation of Liability

The Service is provided "as is" without warranties of any kind. Agentic shall not be liable for any indirect, incidental, or consequential damages arising from the use of the Service, including but not limited to lost profits, data loss, or business interruption.

9. Termination

We reserve the right to suspend or terminate your account if you violate these Terms. You may delete your account at any time through the app settings or by contacting support.

Al acceder o usar Agentic ("el Servicio"), aceptas estar sujeto a estos Términos de Servicio. Si no estás de acuerdo, no uses el Servicio. Nos reservamos el derecho de modificar estos términos en cualquier momento.

2. Descripción del Servicio

Agentic es una plataforma de asistente de negocios con IA que permite a las empresas automatizar las interacciones con clientes a través de agentes de IA desplegados en WhatsApp, Instagram y otros canales de mensajería. El Servicio incluye gestión de conversaciones, gestión de contactos, analíticas y automatización de flujos de trabajo.

3. Registro de Cuenta

• Debes proporcionar información precisa y completa al crear una cuenta
• Eres responsable de mantener la seguridad de tus credenciales
• Debes tener al menos 18 años para usar el Servicio
• Una persona o entidad no puede mantener más de una cuenta gratuita

4. Suscripción y Pagos

Agentic ofrece un plan gratuito y planes de suscripción de pago. Los planes de pago se facturan mensual o anualmente a través de LemonSqueezy. Puedes cancelar tu suscripción en cualquier momento. Al cancelar, mantendrás el acceso hasta el final de tu período de facturación actual, después del cual tu cuenta será degradada al plan gratuito. Los reembolsos se manejan caso por caso.

5. Uso Aceptable

Aceptas NO usar el Servicio para:

• Enviar spam, mensajes no solicitados o comunicaciones masivas
• Violar leyes o regulaciones aplicables
• Suplantar a otra persona o entidad
• Transmitir malware, virus o código dañino
• Intentar acceder a otras cuentas o sistemas sin autorización
• Usar el agente IA para generar contenido dañino, engañoso o ilegal
• Exceder los límites de uso de tu plan mediante medios automatizados

6. Contenido Generado por IA

El agente IA genera respuestas basadas en la información que proporcionas y los modelos de Google Gemini AI. Eres responsable de revisar y monitorear el contenido que tu agente IA produce. Agentic no garantiza la precisión, integridad o idoneidad de las respuestas generadas por IA.

7. Propiedad de los Datos

Conservas la propiedad de todos los datos que proporcionas al Servicio, incluyendo información del negocio, contactos de clientes e historial de conversaciones. Agentic no vende tus datos a terceros. Al eliminar tu cuenta, tus datos se eliminarán permanentemente en un plazo de 30 días.

8. Limitación de Responsabilidad

El Servicio se proporciona "tal cual" sin garantías de ningún tipo. Agentic no será responsable de daños indirectos, incidentales o consecuentes derivados del uso del Servicio, incluyendo pero no limitado a pérdida de beneficios, pérdida de datos o interrupción del negocio.

9. Terminación

Nos reservamos el derecho de suspender o terminar tu cuenta si violas estos Términos. Puedes eliminar tu cuenta en cualquier momento desde la configuración de la app o contactando a soporte.
